Exclusion List Monitoring

Keeping up with the federal and state “exclusion lists” can be a significant challenge. The HHS Office of Inspector General (OIG) mandates that practices check all of their employees and providers against its List of Excluded Individuals and Entities (LEIE) routinely, as well as before they enter into employment or contractual relationships with new individuals. Forty states and multiple other federal agencies have similar requirements. Non-compliance penalties can be crippling: fines up to $22,000 per claim, potential exclusion from government-funded health programs, and expensive legal investigations. Most health care attorneys recommend tracking the exclusion lists monthly.

To help our member practices, Medical Mutual is providing access to a federal and state exclusion list monitoring service—at no additional charge, as a benefit of your membership. Venops (www.venops.com) will track your providers, employees, and vendors against the relevant federal and state exclusion lists every month and send you a monthly report to help you stay compliant. Venops will also archive your monthly tracking reports on their web site.

Open Payments Database

Since its inception in 2014, the federal Open Payments database has made all payments to physicians from pharmaceutical and medical device companies available to the public in a searchable format. This information puts a spotlight on potential conflicts of interest for physicians, and can create internal conflict within a practice if a physician has not reported significant revenue outside of patient care. Moreover, if any information in the database is incorrect, it can create unnecessary damage for the physician and practice.

These risks make it imperative that practices know their physicians’ payment data as early in the process as possible. To support you in that effort, Medical Mutual is partnering with Venops to enhance your access to Open Payments data, giving you an early look so that you can be prepared to respond, and rectify any potential cases of erroneous information. We offer this service at no additional charge, as a benefit of membership in Medical Mutual.

CMS has recently updated their website with reported 2017 Open Payments data, and you will have until December 31 to dispute any inaccurate information for one of your physicians.

To take advantage of this service, simply go to www.venops.com and follow these steps:

  • Click “Login” in the upper right hand corner of the home page
  • Click “New User? Click here to register” toward the bottom Register the practice (Note: you will need your Medical Mutual policy number when you register)
 

Once you click “Register” at the bottom of the Registration page, you will receive a confirmation email from Venops. Within the next two days, you will receive an email notification from Venops Member Services to log back in and retrieve your completed report. When you log in to your Venops dashboard, you will see a navigation button on the right side of your screen labeled “Open Payments Report.” Click on this button and view your report.

This new member benefit, combined with the federal and state exclusion list monitoring service, gives you consolidated reporting for two important programs.
